Terms of Service

1. Acceptance of Terms

By accessing or using MyVoice ("the Service"), operated by Exhort Technologies, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Beta Service

MyVoice is currently offered as a beta service at no cost. During the beta period:

  • The Service is provided free of charge and may include limitations on usage.
  • We may modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.
  • Features, pricing, and availability are subject to change when the Service moves out of beta.
  • We reserve the right to introduce paid plans in the future. You will be notified of any pricing changes in advance.

3. Account Registration

To use the Service, you must create an account and provide accurate information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Generate spam, misleading content, or content intended to deceive.
  • Produce content that is hateful, harassing, defamatory, or that promotes violence.
  • Impersonate another person or entity.
  • Violate any applicable law, regulation, or third-party rights.
  • Abuse the Service through excessive automated requests, scraping, or other means that place an unreasonable burden on our infrastructure.
  • Attempt to circumvent any limitations, security measures, or access controls.

We reserve the right to suspend or terminate any account that violates these terms or that we reasonably believe is being used in an abusive, fraudulent, or harmful manner. This determination is at our sole discretion.

5. Content Ownership and Responsibility

Your content is yours. You retain all rights to the content you create using the Service, including generated drafts. However:

  • You are solely responsible for reviewing, editing, and publishing any content generated by the Service.
  • AI-generated content may contain inaccuracies, biases, or errors. You should review all generated content before publishing.
  • We are not responsible for any consequences resulting from content you publish, whether generated by the Service or not.
  • By using the Service, you grant us a limited license to process your input data (voice settings, knowledge base, principles) solely for the purpose of generating content on your behalf.

6. Privacy and Data

We take your data seriously. Your content, voice profiles, knowledge base items, and principles are stored to provide the Service and are not shared with third parties except:

  • With AI model providers (e.g., Anthropic) for the purpose of content generation. These providers process your data according to their own terms and privacy policies.
  • As required by law or legal process.

You may delete your account and associated data at any time by contacting us.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free.
  • The results obtained from the Service will be accurate, reliable, or meet your requirements.
  • Any errors in the Service will be corrected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Exhort Technologies, LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service.
  • Any content generated by the Service.
  • Unauthorized access to or alteration of your data.
  • Any third-party conduct on the Service.

Our total aggregate liability for all claims relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim (which, during the free beta period, is zero).

9. Indemnification

You agree to indemnify, defend, and hold harmless Exhort Technologies, LLC from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

11. Termination

We may terminate or suspend your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and limitations of liability) will survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
